Abstract
This article addresses the right to housing from the perspective of local development, articulating human rights theories with the Capabilities Approach, formulated by Amartya Sen and Martha Nussbaum. The study aims to investigate to what extent this theoretical perspective allows us to overcome both the limitations arising from the abstraction of natural rights and the restrictions inherent in legal positivism, in order to offer guidelines for the formulation of housing policies. Methodologically, this is a qualitative theoretical essay, based on the assumptions of Francis Meneghetti and critical hermeneutics, developed through bibliographic review and cross-sectional analysis of theoretical frameworks on the production of urban space. The results indicate that housing should be understood as a capability that transcends the notion of a commodity, requiring the management of urban conversion factors and the prevalence of the use value of land over its exchange value. It concludes that overcoming housing vulnerability requires the adoption of strategies capable of ensuring the legal enforceability of the right to housing and promoting the exercise of citizenship in collective urban space.
